thank you, this is helpful. p.s. I just met another set of managers about an employee who has disclosed bipolar disorder. Goodness, is there something in the air here? I hope the adage about things coming in threes isn't correct.....

Can anyone help me here? Thanks.

Well, a new wrinkle. My employee gave his notice to accept another job where he has the kind of flexibility in work hours that he was looking for. This was before I had the chance to begin the conversation about ADA eligibility. On the one hand, …

Thanks Cappy, I will do as you suggest and consult an attorney about our next steps. In your experience do people ever decline to persue the ADA interactive process (in other words decline to get physician medical certification of their condition)?…

Cappy, the internal mailing system seems to be down, but you can send it to caroll1999@aol.com. Thanks a lot.

Thanks, TXHRGuy. As usual, you've raised some important issues and given me some things to think about. I agree with you on the personal time piece, we probably don't want to open that can of works. I have put off looking into any kind of donate…

Oh, yes, we are a federal contractor.

"Do you mind saying the basis of your AAP obligation?" =============== TXHRGuy:I'm not sure I understand your question. Do you mean who is driving the request for using the data for goal-setting?

I am engaging my company in a discussion about our Affirmative Action Plan data, and I can see people already wanting to get analysis of the race/ethnic breakdown in their own work groups in order to fi…

We don't at present, but we are not a sales organization. We have corporate offices, and room for all staff; we consider allowing people to work from home a benefit that we are willing to accommodate, but not necessarily something we need, or want …

Thanks, I should have said that we and the employee fall under the broader qualifications you specified. You both raise good points about the reasons why the second job wouldn't be relevant, and why I should make sure the situation doesn't conflict …

Hi Cappy, That would be great. You can forward it to CarolL1999@aol.com

Iplemon, how do you describe the type of degree-granting institution for which the salary increase is eligible? (e.g. "accredited") Do you differentiate between brick and mortar institutions and online degree-granting institutions?

My response would have been similar to LauLan's except that our experience was in 2004 when we had layoff's mid-summer. By December we felt as though we wouldn't send the wrong message by holding something but we did scale back, had a lunch event a…

Interesting comments from you all, and shows why the matter of visual observation was driving my staff nuts. I consulted with my affirmative action plan consultant, and he sent me a memo from the OFCCP that says visual observation is not required, o…

Cappy, I was interested to see if anyone had knowledge of such a restriction based on regulations, because I do not, and it seems to go against the principle of paying a wage based on the value of the job the person is being asked to do. While the …
The longer you play in the HR sandbox, the more you will appreciate the need not to make exceptions for people when the exception does not have a basis in legal requirement (e.g., ADA accomodation), safety, or a clear business …

Thanks, Cappy, that's helpful.
The purpose of the statement you asked about is to suggest that any reading of any question that suggests to the reader an improper intent on the part of the Company is not really improper. I doubt that really would have any …
So my thinking of your statement was not how to protect the employer if they ask an illegal question but, rather, how to protect your employer from asking an illegal question. Right?
Thanks for sticking with the discussio…

So what you both are saying is that the purpose of the statement I asked about is to protect the employer even if they asked an illegal question? I hadn't even considered that possibility. (and would be surprised if that worked)

We are a 100-person non profit and pay between 60% and 80% depending on the plan design (PPO, HMO, consumer-driven high deductible PPO).

Have you ever run into an employee resigning from a position due to the fact they are not able to post for a position at another office (this is due to our 12 month policy in which an employee must be i…

Thanks, Cheryl, that is very helpful. The cleaner referenced is an employee of a firm we contract with, so I'm guessing they have their own procedures in place.

Thanks everyone for your quick responses. I will consider offering at our company given this feedback.

Maybe it's not a legal question but one of policy for our company. For any disability type FMLA claim we require folks use one week of their PTO before the paid benefit kicks in. Whether it's one or two makes a lot of difference to the employee. …
