Severance Pay

Hi everyone,

 Can anyone tell me if there are any legal rules to paying out severance pay in MASS.  Does it have to be one lump sum, or can we issue a check every  week?  I'd appreciate any input.

  • From what I know, under Massachusetts law, a discharged employee must be paid in full on the day of the termination of his or her employment. Any employee who resigns must be paid on the next regular payday (MA Gen. Laws Ch. 149 Sec. 148).

     Although there is no state law requiring private employers to provide employees with paid or unpaid vacation, vacation time is considered "wages" if the employer provides or has promised paid vacation. Thus, if an employer does provide or promises paid vacation, an employee who leaves the payroll must be paid for accrued, unused, paid vacation time.
