Vacation accrual during leave time

Is anyone aware of any laws that say employers must continue to accrue vacation while an associate if off due to workers' comp or FMLA leave? I have checked my reference manuals both federal and state (Ohio)and it appears that it depends on company policy. Just wanted to double check. Thanks.

Since our accruals are based on hours paid, employees on leave continue to accrue vacation, holiday, and personal time only for the period of time they are with pay.

What if vacation accrual is by length of employment (i.e. 1 year 2 wks, 10 years 3 wks, etc.)? Does anyone who has a length of service accrual stop vacation accrual if an employee is out for 10 or 11 months?

But Betty do you consider pay a worker's comp check or a short term disability check?

What if an employee has a lot of saved vacation time and uses it over a long period of time taking only say 2 days a week.
Would they accrue vacation for the entire period?

We do not have STD, and pay applies only to what the employees receives in a paycheck (can be sick, holiday, and vacation) through our payroll department. Our LTD kicks in at the 91st day of disability. No vacation payout occurs once LTD starts; the unused vacation, if any, is held and nothing further accrues,pending return to work or termination at a later date according to our policy paramters. On an intermittent leave, the individual still would be accruing vacation (up to the maximum allowed), based on the hours being paid each week.

We only accrue if they are receiving payroll checks. STD or LTD pay does not qualify.
