An employee of a small non profit group is required to use her vehicle for agency business. All proper documentation is provided by the employee i.e. valid driver's license, proof of insurance, clean driving record. Her windshield was recently hit by a rogue rock causing damage, this happened when she was traveling for the agency. Is the agency legally obligated to pay for the damages she sustained to her vehicle?

I would guess that you provide this person with a per mile reimbursement rate that is supposed to cover her vehicle expenses. I would think that her insurance would be one of those items. We have employees that are required to use their own vehicles too and we would not cover this.

A bit more serious than the 'rogue rock', I totalled my wife's car just over a year ago while driving on company business. MY insurance had to kick in, not the company's. I learned that according to the company's property and casualty plan, their insurance is secondary to the individual's personal lines policy. The company didn't even pay for the dog house I had to occupy for awhile.
