GINA and Sick Leave

I was wondering how many HR folks were aware of the impact of GINA (the Genetic Nondiscrimination law) on sick leave policies. Sounds like if we require a doctor's note for absences of more than two or three days, we must include a GINA safe harbor statement with the request for the note (see BLR article at

I was unaware of this rule. Anyone else?
