Affirmative Action Plan

We are required to file the EEO-1 form annualy but not because we have a federal contract.  The EEOC said we are required to file because we are a private employer with 100 or more employees.  But are we required to have an Affirmative Action Plan even though we do not have a federal contract.  Help with this matter is greatly appreciated!
