Mandatory Furloughs vs Voluntary Furloughs

Our company (Texas) has been on Mandatory furloughs since Aug/08 and are starting to see an upturn in our profitablity for 1st qtr.  With that said, we would like to move to Voluntary furloughs during 2nd and 3rd qtr then possibly back to Mandatory furloughs start of 4th qtr.  Is this legal in the state of Texas?  Any advise or forseen concerns I should be thinking of?
