NON-COMPETE New Employee Quits Can we alert his new employer?

Non-Compete.  We just had an employee quit that is clearly going to the competition,  At a minimum should we send him a reminder letter of his signed agreement and can  we send anything to his new employer?

I would say that you should do both.  Remind the former employee and make the new employer aware of the agreement --it's possible that your employee never mentioned it to the new employer.  You might also want to give your attorney a heads up on the situation.

Definitely check with your attorney.  NCA enforcement is very dependent on the specific details within the NCA and very dependent on state employment/labor laws.  If an NCA was unenforcable to start with, it might be a bad business practice to use that as a negative reference.
