Cobra - Disability - and Spouse Coverage

Here is the situation:

Previous employee on COBRA coverage for Employee/Spouse. The 18 months ended April 09. Employee received disability and got the extension for him and his spouse. Employee gets full medicare coverage July 1. Will no longer need coverage. Spouse still needs coverage.

 Is spouse still allowed coverage? Is company allowed to charge the 150% on the spouse rate?

 I realize this might be a stupid question. I have not come across this before. I am newer to COBRA policies and just don't want to say the wrong thing to the employee.

  • COBRA states that as a spouse, if the employee becomes eligible for Medicare, then yes, they have the option to continue COBRA.  How that ties into the extension, I'm not sure, but I believe the spouse's time doesn't restart...they just keep going until the three year anniversary of the original qualifying event.
