If an employee is transgender and in transition; how should the employee be counted for EEO1 reports?

    Sharon, I recommend labeling the EEO-1 report according to the gender that the employee identifies with. If the employee has outed himself/herself to the employer, then best practice is to treat the employee as the newly presented gender.
