I have just heard (letter from HHS) about RBIS (Rate & Benefits Information System) for the first time. Doing some preliminary checking it appears that only individual and small market groups have to submit this data. I am assuming that the HHS and CMS consider small groups as being from 1 -50 employees for this reporting. Does anyone know if this is correct?

    According to the Rate and Benefits Information System (RBIS) User Manual:

    "The Center for Consumer Information and Insurance Oversight (CCIIO), a division of the Department of Health and Human Services (HHS), is charged with helping implement many provisions of the Affordable Care Act. CCIIO oversees the implementation of the provisions related to private health insurance including providing oversight for the Issuer based data exchanges that populate http://www.HealthCare.gov.

    The Health Insurance Oversight System (HIOS) allows the government to collect data from individual and small group market Issuers in order to facilitate this charge. The collected data is aggregated with other data sources and made public on a consumer-facing website. The Rate and Benefits Information System (RBIS) web site gathers detailed product benefit and eligibility data...."

    The User Manual can hopefully provide you with some helpful guidance regarding the RBIS.

    Additionally, regarding what is considered a "small group" is a addressed on a page called "Questions and Answers for Plan Finder Data Entry." More specifically, it contains the following question and answer:

    "Q: Our state operates with a small group definition which differs from that proposed by the Affordable Care Act. How do we report the data?

    A: You should report data to the Plan Finder based on the state law and definitions applicable at that time."
