Employee's refusal to do their job
Recently an employee stated they were no longer interested in doing sales anymore for our company. They've refused to complete tasks that everyone else on the sales team completes. He's stated he wants to move back into an office manager role. That position was filled to allow him time to focus on sales. Since he's refusing to do his job and asking for a position that is not open , can I take this as his resignation ? ?

Unless a promise was made or is in your policies somewhere that employees can go back to old positions when new ones do not work out, you can discipline this employee up to and including termination. Your best bet is to remind them that they cannot go back and explain your policies on employees who fail to meet expectations and/or fail to follow company policies and procedures.
