pre employment tobacco screening

I am from South Carolina and I need to konw the thoughts of anyone regarding not hiring applicanrts who
test posititive for tobacca/nicotine in the urine. Any reference to laws, literture reviews etc. will be helpful to me.

    I did a quick search and it appears as though South Carolina may have a statute prohibiting adverse action based on smoking status. I'd check and make sure the reg is still current, though.

    SOUTH CAROLINA: S.C. CODE ANN. § 41-1-85

    § 41-1-85. Personnel action based on use of tobacco products outside of workplace prohibited.

    The use of tobacco products outside the workplace must not be the basis of personnel action, including, but not limited to, employment, termination, demotion, or promotion of an employee.
