In Ohio, what are the regulations for paying out vacation and/or PTO. Can an employer NOT pay out PTO if the employee gives only 1 week of notice when leaving when the employer has a policy that indicates employees must give 2 weeks of notice.

  • No Ohio statute requires employers to provide paid vacation benefits to employees. However, if an employee becomes eligible for vacation pay under an agreement or under company policy, failure to pay the employee for vacation time may be treated as nonpayment of wages.

    You may want to consider stating in an employee handbook your policy on paying out vacation at the time of termination.
