Interrupted FMLA

An employee is going out on a 3-week family and medical leave. She has asked to come in and work one day about a week after her minor surgery because she does not have backup to perform one of the job functions. If her doctor approves it, does the FMLA allow it?

Welcome to the forum.

With a doctor's release that it is okay for her to work the one day, I don't see a problem with it as long as it is her idea to do so. If the company is requiring her to come in, then I think you would have an issue.

I would certify and count this as intermittent FMLA. Is there any reason that someone couldn't be trained in the one duty there is no backup for?
