I am revising our current substance abuse policy. If you read this, would you please let me know what blood alchol level you use to determine if someone is "under the influence" and if it varies based on whether the employee is CDL or not?

No driver shall report for duty or remain on duty requiring the performance of safety-sensitive functions while having an alcohol concentration of 0.04 or greater. No employer having actual knowledge that a driver has an alcohol concentration of 0.04 or greater shall permit the driver to perform or continue to perform safety-sensitive functions.
You might also want to look at 382.205 and 382.207. They outline regulations concerning on-duty use and pre-duty use.
