New to HR and need advice. District Manager called me and we have a manager over two locations who has been verbally abusive to two of his female employees at one location. Just found out that he is having an affair with the receptionist at the other location. I think we need to get an attorney involved - any advice?

    First you need to investigate. If you find your manager is really guilty of these things, then you should look to your procedures and policies. Do you allow your managers to have sexual relationships with those who work for them? (I hope not!) Do you have something in place to protect you against possible sexual harrassment claims (which it looks like you have from all 3 females involved)? Does your policy require you to get this manager more training, or to term them? If they are not clear, or your investigation does not yield clear results, I would definitely seek the advice of a good attorney.

    If you still feel uncomfortable, it doesn't hurt to talk to an attorney anyway. But you should do your homework first so you spend less time in consultation and more time fixing the problem.

  • I agree with Nae! You may have one sexual harassment claim and two discrimination/unlawful harassment claims, based on gender. An investigation is definitely in order.
  • The more homework you do now, the less money you will pay the attorney. There is nothing worse than knowing you are paying someone a few hundred dollars an hour to listen to you leaf through files, policies, and handbooks.
  • Get on the investigation, pronto. If you have never done one, let us know and am sure we can help.
