Missouri--Overtime for commission sales persons

[font size="1" color="#FF0000"]LAST EDITED ON 11-28-07 AT 03:28PM (CST)[/font][br][br]Before Missouri passed Proposition B in the fall of 2006, an employer could avoid paying overtime to commission sales persons in Missouri by satisfying the requirments of section 7(i) of the federal fair labor standards act. It is my understanding that Proposition B effectively eliminated that exemption and that commission sales person are now entitled to overtime pay. Does anyone know how Missouri is enforcing this overtime requirement for commission sales persons in retail establishments whose hours and places of employment are controlled by the employer? If commission sales persons are paid a guaranteed draw, can you use the guaranteed draw as the "regular compensation" rate? Or is the regular compensation rate the guaranteed draw plus commissions?
