Overtime for hours not "worked" (Pennsylvania)

We have an employee at our daycare center who attends college part time. We received a grant that allows us to pay her for 2 hours to allow her to leave work early to attend class and for some "observation" time in our class rooms. The grant then reimburses us for those wages.

So this week, for example, she had 36 hours of work time and 5 hours of "observation" time in which she was at work, not actually working, but conducting an observation as part of her class. Do we need to pay her 1 hour of overtime?

  • The observation is to pass her class, right? If that's the case she's not working for you and shouldn't get paid.

    The other factor is the grant. I'm not sure I understand the grant. Does it cover two hours a day or two hours a week? If it's a week I think she "worked" 38 hours and you don't worry about overtime.

    You could always call your local DOL and ask them.
