NY Frequency of Payment

Can anyone confirm that NYS Labor Law requires non-exempt employees to be paid (salary) either bi-weekly or semi-monthy? If this is true is anyone aware of a provision within NYS Labor Laws which allow non-exempt employees to be paid on a monthly basis?

Thanks

  • Hello rk,

I checked our 50 Employment Laws in 50 States book, and (as of January 2006) it looks like New York makes a distinction between "clerical and other workers," "manual workers," railroad workers," and "commissioned sales people." It also depends on the amount the employee is paid and the size of the employer. Plus, there are various exceptions. You might check Article 6 of the state Labor Law, Sections 190 and 191.
