We have a salary nonexempt employee who takes work home to finish it. She states that she can not get it all done at work. My question is we do not pay her the overtime for doing the work at home, but since we know she is doing it, should we pay her anyway? Are we in any violations with wage and hour if we don't pay her overtime for working at home on her own?

I'd be concerned about why she can't get all her work done and look in to that.
