outside sales exemption

The FLSA exempts outside salesmen for overtime pay. How much control over an outside salesman can an employer exercise before the exemption is lost? Can an employer require the salesman to check in at the office at the start and end of each day?

  • Absolutely.

    I am not sure how the exemption works for outside sales people, but as long as you are not paying based on the check-in as the beginning of the day and the check-out as the end of the day - like a time clock - then you are OK.

    Even exempts can be required to do a similar process and not lose the status.
