Would anyone have any hesitation in making an employee with a masters in social work, who performs counselling for folks with emotional or mental health problems an exempt EE? It seems to me it fits with the professional esemption, but I just couldn't find it in black and white. Thanks.

We do that exact thing for Marriage and Family Therapist, who happen to be licenses. You did not mention any licensing, but I think it is required for most of this type of counseling.

Of course all professional counselors are exempt. Those performing tasks such as test administration or counselor aide activities would not be.
