Part Time Exempt Employees

We have a full time professional (nurse) who is leaving our employ. We want to replace her with two part-time people working 20 hours each per week. Can we make these part time people exempt? They would probably work over 20 hours some weeks and not quite 20 on other weeks.

  • We have 2 part-time exempt nurses. You just have to agree to the job requirements and salary.

    We used to have one work mornings and the other afternoons, but we have changed it. Now one works 40 one week, and the other works 40 the next week. They requested this change and it has worked well.

  • Remember that exempt and non-exempt are designations of the position, based on the job duties, not designations of the individual(s) occupying the position(s). If the duties of the job meet the exemption test, you can label the job exempt regardless of the hours of the employees) filling it.
  • You folks with pt exmpts will want to look closely at the new regs ( assuming they ever become effective ) because the minimum sal requirments are likely to impact on pts more than fts.
