I just want to make sure I am correct before addessing a staff person doing payroll - If someone works 8 hrs. Mon, Tues, Wed. & 9 hrs. Thurs. & takes a vacation day Friday (usually given in 6 hr. increments), he would not get 1 hr. overtime - correct? He would only use 7 hrs. of his vacation time & have an extra hour to use later. Simply, I guess I am asking if we must pay OT if vacation or sick time is used during that week to increase hours over 40.

However, some states require that you pay overtime per day (over 8 hours worked in the day). I believe California is one of these, but I'm not sure what the others are.
