Severence Pay

We have an employee in our New York office who started receiving severence. The employee at the time of severence lived in the State of New Jersey. We were taking New York State Tax out on him at the time of severence due to him working in the New York office.

He moved to the State of North Carolina (we also have an office here in which he use to work out of) and has filled out an NC-4 form for which he wants us to take NC tax from (although this is zero since in the State of NC severence is non-taxable).

Can anyone give me a reason why we shouldn't comply or if there is any legal ramifications I should be aware of?
