Exempt day off pay deduction

My question is that we have some supervisors that are salaried exempt. We sometimes have short slowdowns in production. We still ask the supervisors to come in during these slowdowns. If a salary exempt supervisor decides to take a day off during that slowdown time can we deduct that day from his salary? Assume for this question that the employee does not have any vacation or other comp time available at this time.

  • As long as the employer is not telling the exempt supervisor not to come to work because there is no work for the day. If the employe wants to take a full day off for personal reasons when work is light, then the employer may dock the day's absence from the weekly salary, even if the employee is out of PTO or vacation time. Unlike absences due to illness, the emplyer may dock the full day's absence for personal reasons even if there is no PTO or paid vacation time bank in the first place.
