partial exemptions?

Anyone familiar with the status of partially exempt, as it relates to correctional personnel? For instance, my agency pays (for persons in this category) overtime on the basis of hours physically present at work over 171 in a 28 day work period. If anyone is familiar with this section of FLSA law, please reference it for me. Thanks.

    Public sector employers can control a little bit more the pay of exempt employees related to the time they work than private sector employers.

    By "correctional" do you mean prison guards and related activites, police officers, parole and probation officers, or exactly what?

    There are some FLSA provisions that address that.

    Take a look at 29CFR553.201 and following sections.

  • Thanks for info. Have not had a chance yet to review materials you referenced, but look forward to doing so this week. Am in Alabama, public non-profit organization. 3 juvenile corrections facilities/programs(secure detention, boot camp, group home). Realize some of our staff do not qualify for partial exemption(e.g. group home, clerical, etc,) but some do. Thanks again.
