hours in a pay period

I have an employee who is hourly, we pay on a semi-monthly schedule, she would like to work 4 days at 9 hours and the 5th day for 4 hours to = 40 hours in a given week. or to adjust her schedule on an as needed basis per day but to stay withint the 40 hours per week. Would we be within the law to do this without worrying about any overtime (unless required) pay if we stay within the 40 hours for the week?

or since we are semi-monthly the 2 pay periods are 86.67 per pay period would we need to be concerned within these hours.
