Entitlement to vacation pay while on suspension

When an associate tests positive for drugs, our policy is to suspend them without pay until they have seen a SAP and get an all clear to return to work. My question is, can we legally not allow them to take earned vacation pay for the time they were off on suspension? I'm in the state of Ohio.

  • [font size="1" color="#FF0000"]LAST EDITED ON 09-09-02 AT 02:14PM (CST)[/font][p]I don't know what a legal challenge would bring; but, I would not allow a person on suspension-without-pay to take vacation, thereby totally negating the suspension. I think we will find that a majority of the vacation policies in the country say something about the vacation having to be approved and taken at a time conducive to business operations. Good question for an attorney though.
