Can FT EE work PT in another dept w/o OT?

We are a city in Ohio. We have an Administrative Asst at City Hall that would like to take a PT job at our city-owned Fitness Center. I am of the understanding that if she works two jobs, we have to pay OT for the extra hours since she is working for the same employer in the same work week. Is there any way around this?

I don't think so - at least it didn't work in AZ. I work at a Tribal owned gaming facility. The Tribe also owns a convenience market, among other things. Folks were working full time for us, part time at the market. We started getting dinged for OT, so had to make them choose one work place or the other. I guesss you could play some games if you had an exempt ee but that could cause you a whole different set of problems.

From what I understand of the FLSA, I wouldn't try it. I think you need to bite the bullet and pay the OT if you are going to allow her to work both jobs.
