Overtime calculations

Our policy is that we will pay overtime in weeks where a vacation or paid personal day is taken based on a reduced overtime ceiling. For example, if an associate is off for one day during the week we reduce the overtime ceiling to 32 hours and pay OT for anything over that. We now have a situation where an associate worked on Sunday (this was an unsual situation as we are not open on Sunday)and then took vacation for the rest of the week. Our workweek runs from Sunday through Saturday. The owner thinks all the hours worked on Sunday should be OT based on our policy of reducing the OT ceiling. I think he should be paid straight time. Help!

  • Based on the policy your company has chosen to follow, it seems to me that if she was on vacation Mon-Fri of the week that began on Sunday, then your policy suggests that her workweek ceiling be reduced to zero, meaning that any time she worked over zero hours is compensated as overtime. Using your formula, as I understand it, it looks like the owner is correct and she gets time and a half for all the Sunday hours.
