Re-Hire and FSA

Greetings! During this plan year, we had an employee leave for another job. When she left we reimbursed for all expenses incurred, though the P/R deductions were less, as required by law. She has now returned and wants to get back into the plan. How does that work? Any advise would be much appreciated! Cathy

I believe she would have to wait until your open enrollment to get back on the FSA portion or it would be your standard time frame 30, 60, 90 day waiting period before benefits are granted unless you have a policy that states if rehired within such and such time you will use original hire date or something to that regard.

Study your plan language carefully, and/or check with your plan's TPA if you have one - this MAY be an opportunity for you to recoup the shortage.

I have checked the plan docs and it is not specific to re-hired employees. The policy states eligibility coincides with health insurance eligibility. Thanks for the info!
