Restoring place on vacation ladder

EE is being rehired after less than a 6 month break in service. Our vacation policy is 12 days per year to start, rising to 18 days in 3 years. We have no formal policy about breaks in service with respect to vacation time.

Two other rehires were gone more than a year and we did not even consider putting them on the ladder in the same place they were when they left.

Opine please.

We would not put them back on the vacation ladder, but we have a vacation policy that states they must have one continuous year of employement to be eligible for vacation. If this is the first time it has occured you could be setting your program going forward. Is the former employer expecting to retain their vacation senority?

I am not aware of her expectation, we are just trying to determine if a policy should be set, and what others are doing.

On the surface it appears you're under no obligation to treat her any differently than those re-hired >1yr.
We permit employees who return w/in 6 mos to be restored to their prior vacation accrual rate and proceed into the future. More than 6 mos means you start over as a brand new hire.
