Cobra Question

We have a surviving spouse on COBRA. She just turned 65 and has Medicare. Can we drop the COBRA coverage now that she is on Medicare?

  • In my opinion, the law says that being eligible for Medicare is different than enrolling in Medicare. COBRA coverage must continue until the person is enrolled, not just if they turn 65. If you already know this person is enrolled in Medicare, I would contact this person and discuss the situation. Theoretically, they should not want to continue to pay high premiums for medical coverage if Medicare now is primary, and they will voluntarily request dropping COBRA. However, I do understand the benefits to a plan with prescription benefits, but my guess is the total premium is a lot to pay for Rx only. If she wants to continue on COBRA but is in Medicare, then I would get a professional opinion about your rights to drop her.
