COBRA and W/C

I have an employee who has been on worker's comp for several months and has been paying her health insurance through COBRA.

If she returns to work on a part-time basis, do we keep her on COBRA until she reaches 20 hours per week which is the minimum hours required by our insurance carrier?

  • This employee is eligble for COBRA until she becomes eligible for regular coverage or her COBRA expires. Remember, employees who lose eligibility for health coverage due to reduced hours are eligible for continuation of benefits through COBRA. They then revert back to regular coverage when they resume a regular schedule. It sounds like your employee meets this criteria.

    Whether or not there is a waiting period after increasing hours worked depends upon your plan document and policies. Also, you can usually call your insurance company, agent, or broker to get specific information about dates, etc.
