Laid Off Employee Call Back

Our Company had to Lay off several employee's last Septemeber. We called back one of the employee's. I was curious as to whether or not there is anything special I need to do? I've gotten this employee's Insurances started up again, but is there anything else that I am missing paperwork wise? This is all new to me and I would greatly appreciate any help or advice in this matter.

It's unclear about whether the person on lay-off status was still an inactive employee or was termination due to RIF. If the latter, then doing what you normally do for new hires would seem appropriate. If the former, then your org must have a policy in place to specify how the employee returns, do they get a new hire date, adjusted date (by am't of time gone), etc.......

You will want to reverify the returning employee's I-9 status and probably will want them to complete and updated (2001) W-4 form. You should also report them as a "new hire" to your state New Hire Reporting Center.

If your company offers a 401(k) plan, and the employee was eligible for the plan before he or she was laid off, don't forget to start his/her deferrals again. They do not have to wait for an entry date to start contributing.

Thank you all very much for your help. It sounds like I have done all the paperwork in the correct manner, with the new hire date and I-9. This employee was just inactive and not terminated. Again...thank you!
