Pre-tax COBRA payments?

A group health plan participant is going to pay the COBRA premiums for his son who has become an overage dependent on the group health plan. The participant already pays the employee portion of his own group health premium via pre-tax payroll deduction, i.e., Premium Conversion. Can the participant also pay the COBRA premiums for the overage dependent child using pre-tax payroll deduction?

  • If the child continues to be a dependent of the employee for federal tax purposes, the answer is yes, the employee may elect to pay COBRA premiums for the child on a pretax basis. However, the plan documents must specifically allow for such an election. The change salary reduction election must also be made in accordance with the family status change rules written into the plan.
