Copy of Doctors Excuse

I have had an employee bring in "copies" of a doctor's excuse for intermittent FMLA for her child. I have reason to believe that these excuses could be bogus as they seem to always occur on a Friday or a Monday. Is there any reason that you know of that an employer cannot require the original doctor's excuse?

  • You can't "require" any additional documentation once the intermittent leave has been approved.
  • You CAN ask for recertification every 30 days, as long as it doesn't turn into harrassment. You can also get a 2nd opinion (company must pay for).

    If it were me, I would send the paperwork, along with the employee's work schedule and history of absences, with the employee to the doctor. Most doctors will resist being used by an employee this way. If the doctor completes the paperwork there is really nothing you can do except get a 2nd opinion. If you really think the employee is pulling a fast one, that may be the way to go in the first place.
