WC - Employee working for cash covered?

We have a kitchen employee who moonlighted one evening for another employer & earned $50.00 cash - casual labor. While there he fell & injured his knee. Shouldn't this injury be covered under that employers worker's compensation?

Unless he was there as a representative of your company, as an employee, it would fall under their worker's compensation insurance. The fact that he was paid cash may have an impact as he technically wasn't an employee. I would recommend that the employee talk with the other employer but it shouldn't be your injury to report.

If he was paid in cash, it is a good chance this employer will say he "wasn't working for him" or why wouldn't he do the tax and I=9 bit. It could be that this is a smaller employer and isn't required to carry unemployment. I would make sure it isn't reported as w/c and if he is filing it under his group coverage, I would make sure that they know it was from an accident where he was gainfully employed by someone else. (They will either deny or subrogate.) Make sure that you have something to back you up in case all of a sudden this employee changes his story.

If the employer has one or more employees, he pays UI taxes. I don't know about comp.
