Worker's comp

I have an employee who had a worker's comp claim back in Oct of 2001. He slipped on ice and injured his back. This case has not been closed as of yet. Then in Nov of 2001 he had another ice slip and injured his shoulder requiring rotator cuff surgery. He came back to work last week on very limited duty. Upon returning to work from his therapy today, he informed his supervisor that he is scheduled for a MRI this Friday for his back injury. This pattern just keeps coming. His reply to his supervisor this morning was that next year would be his last year anyway. The problem is that he is one of our maintenance crew and is unable to perform his job duties. We could put him on as a school bus driver but that would only be 4 - 6 hours a day, down from his 8 hr shift. He is a sub driver for us and has been for years earning overtime usually. Can we reassign him to driver only?
