simple question ( I think)

I have an employee who is averaging calling in sick about 1 day/week. Rarely out more than 1 day in a row. I do not know if she has a chronic illness causing this. Questions:
(1) If she does have a chronic illness, does this fall under FMLA?
(2)How do I find out if she has an illness that would qualify her for FMLA?

    If she meets all of the qualifications for entitlement, you simply advise her of her rights and responsibilities under the REGS in writing, provide her with a physician's certification form and see what you get. If indeed she does have a chronic illness that requires her to intermittently be off, it may qualify. Unfortunately we are not DRs so can't give you a straight yes or no.

  • There is a standard DOL form that you may download from their Website but it is very cumbersome for all parties concerned. As long as you have what your company decides is essential information needed for you to make a decision included, you may create your own form. The key is to always advise the EE of their rights and responsibilities in writing and be consistent with all EEs.
