FMLA Intermittent Documentation

Can I request from an employee who uses FMLA intermittently due to a serious health condition for themself or a spouse for documentation/note from doctor each time they are gone? I do have a Certification of Health Care Provider. Thanks

  • If you have approved intermittent FMLA you cannot required a physician's slip each time they miss, unless you have an attendance policy that does the same for any other person calling in sick. For example, our attendance policy states that absences of three days or more require a physician's release before a person is allowed to return to work. This applies to both FMLA and non-FMLA situations. So unless you require ALL employees who call in sick to provide a doctor's note, you cannot require FMLA absences to do it.
