We have an employee who is out on FLMA. She was the last one hired in the dept. We need to lay her off, but do we have to wait until she comes back from leave, which would mid-November, or can we lay her off now.

You can go ahead and lay her off now just make sure you have solid documentation verifying that her layoff was due to business reasons and not as retaliation for her utilizing the FMLA leave.
