fmla 4 form fraud

Some employees in our office have filled out some of the fmla form and then gone to the DR which the DR signed and faxed in. Many of the employess say the DR wants the employee to fill out the paper work and then they will sign. Is this FRAUD?

I agree with the other poster who said it sounds like a lazy doctor. That doctor is still signing the form and therefore putting his or her certification on the form, verifying that all is correct. Now, if the employee were actually signing the form instead of the dr, then that's a whole different story!

How can the employer possibly fill out the form? Is the employer a qualified physician? I doubt it. It is the responsibility of the physician to fill out the form. Now, might they charge a fee to do this? Yes, they might, but if they did I'd be looking for another doctor!

Not only is the employer not a doctor; but, the employer has no knowledge of whether or not the ee can work, doesn't know the answers to the 'regimen of treatment' questions, cannot predict the stop work and return to work dates and cannot possibly know how to classify the medical condition or if one exists. A better idea is for his nurse to fill it out and have him sign it.
