I have an employee who was out 5 complete days with whiplash due to an car accident. She is continuing to work only 3-4 hour days (7 days of this now) The doctor's note says she can work 3-4 hours or to a level that is comfortable for her. We,unfortunately, did not put her under FMLA. I know there is the 2 day designation rule. However, 2 weeks later, we would like to start the clock going. Can I start FMLA 2 days ago? Or is it no longer an option?
