FMLA Intermittent Lv Absence Verification

Can an employer require proof that an absence was due to previously certified FMLA intermittent leave? eg. doctor's excuse, statement from employee

  • If you have an employee for whom FMLA has been previously approved for intermittment leave, you cannot require a doctor's slip for each absence. You can, however, require periodic updates to the certification (typically that is done on an annual basis for a long-term chronic condition). As far as a statement from the employee, all the employee needs to tell you is that the absence is for FMLA, once the approval has been completed.
