Entitled to FMLA ??

If you have a parent in California and a parent in Nevada, who have joint custody of a child, age 10, with the parent in California having physical custody, who is seriously ill and may be unable to care for their child temporarily, would the parent employed in Nevada be eligible for FMLA (have been employed for more than 12 months and has worked more than 1,250 hours) to care for their child in California temporarily, in an effort to cause minimal trauma and change to their childs life?

If the kid's healthy, I don't think the FMLA gives the parent the right to leave, although you can give it if you want. If the parents are still married, then things could get complicated.

Parents are divorced......

This situation does not seem to fit FMLA since the child's medical is not the issue and the two parents are divorced. Might be more of a custody issue. Sounds like a company decision on whether or not to grant a defined leave of absence for an unusual circumstance. But, since California is mentioned in the scenario, I make absolutely no assumptions as to the outcome.
