I have an employee who was treated for depression and was out on FMLA. Now the medication he takes for the depression sometimes makes him sick to his stomach and he calls in sick. Is this considered under FMLA?

You still have the same right to require/obtain medical certification for this condition.

If the medical certification regarding the employee's depression does not address medication side effects, give the employee a new certification form for his physician to fill out. Moreover, if he is incapacitated due to the medication, this could be an ADA matter as well. So, obtain as much information from the employee's physician, via the employee, to enable you to make sound decisions.
