Non payment of exempt employee for facility closure

Good Afternoon All;

Question, If we closed the facility for one week between Christmas and New Year's, and an exempt employee did not have vacation time to use so do I have to pay him?

  • I was on the DOL website but couldn't find any clarification beyond - if an exempt employee does not work any part of the week then you do not have to pay. My only concern is that the facility was closed and he was unable to work.

My response is based on DOL guidance I received when I researched this question several years back when my organization was considering closing during the Christmas to New Year's week (we ended up closing for only one day). You will want to check your state's wage and hour laws as they may provide the employee additional rights.
